Because there are so many online casinos, companies and individuals offering online gambling, it is important to remember that there is some form of legislation regulating this type of activity. In the United States, online gambling is overseen by the states that have legalized gambling and placed restrictions on how licensed casinos can conduct their business. In most states, this means online casinos must register with the state before they can operate. Most states also require that these companies have some form of payment processor protection to prevent their clients from spending money without their knowledge. Additionally, many states also require casinos to post a warning about online gambling and include the location and hours of operation in their websites.

As a final note, many states have imposed limitations or outright banning online gambling because of the high level of fraud that is prevalent in this industry. For example, in 2021, the state of Delaware enacted House Bill 1183 which sought to regulate online casinos and other gaming establishments including Internet poker sites. The law specifically includes out of state gambling activity and requires licensed casinos and Internet poker sites to apply for a license through the department of revenue. Additionally, all online casinos must be licensed through the state to conduct business in that state.
